Question: Still owe and paying 2005 taxes – will the economic refund go towards them?

Long story short, my husband was a sub-contractor for a guy that never gave him a 1099 so we filed for taxes one year and our entire income for the year was only $15,000 – seemingly out of nowhere because he didn’t get any papers from his boss (basically, under the table). The total taxes we had to pay came out to $2,500 and we have a little over $100 left to pay on them (they are in a program so we pay a little each month).

Will the economic stimulus refund go towards those taxes without us ever seeing the money? How will that work? We did direct deposit for our taxes this year which we didn’t get because they went towards paying for our 2005 taxes but they have our bank info on file and today is the 9th (we should have it today according to their charts), but no show yet.
lovred – But we’ll get some of it, at some point. We only have a little over $100 left and I’m estimating our refund to be $600-750 according to our AGI.

Answer: You will not get the stimulus check if you still owe past taxes.

From Irs Website:

Q. I’m eligible for a payment but I still owe federal income tax from a prior year. Will my payment be reduced?

A. Yes. For this purpose, the stimulus payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state Income Taxes or non-Tax Federal debt such as student loans and child support.
