Question: Can a federal return be amended so that the other parent can claim the children?

This question was just answered for me by Frissy, but there is no respond area:
If we were to see a JP, wouldn’t that only count for the 2009 year and not Last Tax Year sicne we weren’t married?

I actually haven’t been denied or rejected yet, I was told that it was under review and the only reason I could think of was the 1099T. Thats how the 3 weeks came about. I am just trying to make sure I know what to do after the 3 weeks is up if my return is rejected. My girlfriend hasn’t filed her taxes yet and doesnt want to until March, (her budgeting idea).

Under review means they are processing it. What program are you using?

What part of budgeting is filing taxes going to affect? Filing your Tax Return is free if you fill out the 1040 yourself. Fill out the forms with your correct information, and do a set with you claiming them, and with her claiming them.

And, yes, you will be able to file MFJ next tax year, but it’s still true that if you have vastly disparate incomes, you will be better off filing jointly.
