Question: What do I need to do to file a final tax for deceased vs. estate?
In 2007 my grandmother died. I filed taxes for my grandparents, having listed her as deceased and included all rental property. However, all property was in her name and moved into an estate with a separate 706 being filed. In 2008 my grandfather passed away. I know I need to file a final tax for him but should I include the property even though it was not in his name. Or should the property be filed separately? I use a tax program and it included everything.
Answer: The tax program is correct. The gross estate is file via form 706
Later you as the executrix or administratrix of the estate will file a final return for the deceased. Probably joint return for 2007: Write the word deceased on top of the return for 2007 and and 2008 for your grandfather.
File the final return on form 1040 with attached schedule E for rental income. There is a form you can use to have the tax refund sent back to the estate or you must file and it is form 1310
Please put the word deceased after the deceased person’s name on this form and any other form
