Question: Where can i get free advice about a uk visa for my husband.?
I am British, and married my husband in june 2007. His first visa application was refused on the basis that i was on disabled benefits, in Nov 2007. I am currently struggeling trying to find ‘permitted work’ of 12 hours a week ( its extremely difficult because 1, where i live ( rural ) 2, my disability /illness and 3 ive not worked since 1999 ) My nearest IAS office is 4 hours on the bus so please dont suggest that, they dont offer a telephone or email service either. My local CAB office has ‘insufficient’ knowledge and refered me to IAS, which as i just said is impossible for me to get to. My husband is currently living in Asia.
I desperatly need advice because the whole situation is bringing me close to a breakdown with stress. My husband is 100% wanting to work and pay british taxes and only wants to look after me. I CANT live in his country, ( i have tried for 11 weeks )
I need a free service, email or phone. Or any advice here given by legal experts much appriciated.Answer: Sweetie I am so sorry you find yourself in this situation. Unfortunately the rules are clear you can not be on any type of benefit to apply for a visa for a spouse/family, which you say was refused in November 2007. Once you are off the benefits then your application is likely to succeed/
Until you get a job there is no chance of a successful outcome, Have you looked into him applying through the HSMP system? getting a visa on his own merit?
What about an appeal? Going on what you said you could look at that option. However I don’t know if it would be successful, as you have not fulfilled the requirements.
