Question: As a California resident who received no income for 2006 do i have to file a state Tax Return?
I am a military spouse and homemaker
Answer: It would definitely be beneficial for you to file at least for the federal portion. If CA is a state that allows you to file a separate status from the federal, it may not matter depending on where your spouse is stationed. Outside of CA, his military pay is not taxed by the state. Just make sure he files as a non-resident and excludes his military pay earned outside of CA from the calculation. (If he earned any at all in CA, it would be taxable and beneficial to file joint)If he paid any, he would get it all back. If none was withheld, he will not have to file. However it may just be easier to go ahead and file jointly. Though your question doesn’t deal with federal, if not already done, I’d file with him. Especially if there are any dependents and EIC and so forth.
